Terms of Service

These Terms of Service ("Terms") govern your use of the AgenticMD service. By enrolling or sending a message to an AgenticMD number, you agree to these Terms. If you do not agree, do not use the service.

AgenticMD is not for medical emergencies. If you are experiencing chest pain, difficulty breathing, signs of stroke, severe bleeding, a psychiatric emergency, or any other life-threatening symptom, call 911 or go to the nearest Emergency Department immediately. Do not text AgenticMD with emergency concerns — message delivery and response timing are not guaranteed.

1. Description of service

AgenticMD is an AI-assisted SMS service that allows established patients to communicate with their primary-care physician's practice. An AI agent conducts a structured intake conversation with you. Every clinical action — medication orders, referrals, diagnostic recommendations, clinical advice — is reviewed and approved by your physician before being finalized or communicated back to you.

2. Medical disclaimer

AgenticMD's AI agent does not diagnose, prescribe, or deliver clinical advice autonomously. Any information you receive through AgenticMD prior to physician approval is preliminary and not medical advice. AgenticMD is a tool that supports your physician; it is not a substitute for professional medical judgment.

3. Eligibility

You must be:

An established patient of a physician who has enrolled their practice in AgenticMD;
18 years of age or older, or enrolled by a parent or legal guardian under applicable state law; and
Able to provide verifiable identity confirmation via date of birth and MyChart OAuth authentication.

4. Authentication

Before any clinical information is exchanged, AgenticMD verifies your identity through two factors: your date of birth and a MyChart OAuth login. Three failed authentication attempts will result in temporary account lockout. You are responsible for maintaining the confidentiality of your MyChart credentials and your mobile device.

5. SMS messaging terms

By opting in, you consent to receive SMS messages from AgenticMD related to your care. Message frequency varies based on your clinical needs and your physician's outreach.
Message and data rates may apply per your mobile carrier. AgenticMD does not charge for messages itself.
Reply STOP to any message to opt out. Reply HELP for help. Opt-out is effective immediately.
SMS delivery is provided by third-party carriers and is not guaranteed. Delivery delays, carrier filtering, and device-specific failures may occur.

6. User responsibilities

You agree to:

Provide accurate, truthful information during enrollment and intake;
Use AgenticMD solely for your own care or the care of a minor or dependent for whom you are the legal guardian;
Not misuse the service, including by sending harassing, abusive, or unlawful content, attempting to probe or exploit the system, or impersonating another person;
Contact 911 or the Emergency Department for emergencies, not AgenticMD.

7. Privacy

Your use of AgenticMD is also governed by our Privacy Policy, which describes how we collect, use, and protect your information, including protected health information under HIPAA.

8. Termination

You may stop using AgenticMD at any time by replying STOP. We may suspend or terminate your access at our discretion, including for violations of these Terms, suspected fraud, or safety concerns. Termination does not affect any obligations or rights that accrued before termination.

9. Disclaimers

AgenticMD is provided on an "as is" and "as available" basis. To the fullest extent permitted by law, AgenticMD disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the service will be uninterrupted, error-free, or always accurate, and we do not warrant specific clinical outcomes.

10. Limitation of liability

To the fullest extent permitted by law, AgenticMD LLC and its officers, employees, and contractors will not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to your use of the service. Our total liability for any claim arising from these Terms will not exceed one hundred U.S. dollars ($100.00) or the amount you paid us in the twelve months preceding the claim, whichever is greater. Some jurisdictions do not allow these limitations; in those jurisdictions, our liability is limited to the smallest amount permitted by law.

11. Indemnification

You agree to indemnify and hold harmless AgenticMD LLC from any claim arising out of your misuse of the service or violation of these Terms.

12. Governing law and disputes

These Terms are governed by the laws of the State of Ohio, without regard to conflict-of-law principles. Any dispute arising under these Terms will be resolved exclusively in the state or federal courts located in Lucas County, Ohio. You waive any objection to venue or forum in those courts.

13. Changes to these Terms

We may update these Terms from time to time. Material changes will be posted at agenticmd.io/terms with an updated effective date. Continued use of the service after changes constitutes acceptance.
